Terms of Service

1. Acceptance of Terms

By using ARK Status ("the Service"), you agree to these terms. We may update these terms from time to time, and material changes will apply from the stated effective date. Continued use after that effective date constitutes acceptance of the updated terms.

2. Service Description

The Service provides:

  • Real-time game server status monitoring
  • Historical performance data
  • Third-party game server metrics aggregation
  • User accounts with favourite server tracking
  • Discord webhook and bot notifications for server status changes

Data is provided "as-is" without guarantees of accuracy.

3. Premium Service

ARK Status Premium is a paid account add-on that increases selected account limits and may provide benefits such as an ad-free signed-in experience, higher fair-use API limits, additional favourites, watchlists, webhooks, and account status badges. Premium does not guarantee any particular server ranking, search result placement, uptime, monitoring interval, notification delivery time, data accuracy, or continued availability of any third-party platform.

  • Premium is supplied to the Discord-authenticated ARK Status account that completes checkout. It is not transferable unless we agree in writing.
  • Premium checkout and recurring billing are handled by PayPal. The price, billing period, renewal terms, and payment method are shown on the Premium page or during PayPal checkout before you subscribe. PayPal may apply its own terms, checks, payment timing, and account requirements.
  • Premium access normally starts as soon as payment activation is confirmed. During checkout, you must expressly request immediate supply of Premium digital services and account benefits. You acknowledge that once access starts you may lose the 14-day cancellation right for digital content, and for any service element you may have to pay reasonable costs for services supplied before cancellation. This does not affect rights that cannot lawfully be excluded, including rights for services or digital content that are faulty, not as described, or not supplied with reasonable care and skill.
  • You can cancel a recurring Premium subscription through ARK Status or PayPal. Unless we state otherwise, cancellation stops future renewals and Premium access remains available until the end of the paid period. To exercise any statutory cancellation right, email [email protected] with your ARK Status account details and a clear cancellation statement. You can use the wording: "I cancel my ARK Status Premium subscription."
  • We do not normally provide partial refunds for unused time after cancellation, except where required by law, where there has been a billing error, duplicate payment, or another case we accept at our discretion.
  • Published Premium limits are fair-use limits, not dedicated capacity guarantees. We may apply temporary throttles or restrictions to protect service stability, comply with law or platform rules, prevent abuse, or respond to security incidents.
  • We may change Premium features, plan limits, pricing, renewal terms, or the way benefits are delivered. For material adverse changes to paid Premium limits or pricing, we will give at least 30 days’ notice before the change affects an active paid period or renewal, unless a shorter period is reasonably needed for legal, security, abuse-prevention, third-party platform, payment-provider, or technical stability reasons. Price increases will not apply until a renewal after the notice period.
  • If we make a material adverse Premium change and you do not accept it, you can cancel before the next renewal. If such a change substantially removes a core paid benefit during your current paid period, you may request a pro-rata refund for the unused paid period from the date the change takes effect, unless the change is required for legal, security, abuse-prevention, third-party platform, payment-provider, or technical stability reasons. Where the law requires another remedy, we will provide that remedy.
  • We may suspend or remove Premium benefits without refund where an account breaches these terms, abuses the Service, attempts to bypass limits, misuses API access, or creates payment, fraud, chargeback, or security risk. This does not limit any rights you have under applicable law.

4. Discord Bot Service

We operate the ARK Status Discord bot (the "Bot") to deliver automated updates inside Discord guilds. The Bot is part of the Service, and by inviting or managing it you confirm that you have the authority to bind the relevant guild or organisation to these Terms.

  • You must invite the Bot through arkstatus.com so we can provision the guild and apply rate limits fairly.
  • You will only operate the Bot in compliance with the Discord Developer Terms of Service, the Discord Terms of Service, and these Terms.
  • You are responsible for the permissions you grant the Bot, ensuring that the configured notification channel remains accessible, and keeping any API keys or configuration tokens secure.
  • You will not interfere with security controls, attempt to reverse engineer the Bot, exceed published rate limits, or use the Bot for automated scraping or abusive behaviour.

5. Guild Eligibility & Automated Removal

To protect users and comply with Discord policy we only support guilds that complete onboarding through arkstatus.com and maintain valid configuration.

  • Guilds must configure a notification channel within 10 minutes of the Bot joining. Failure to do so may result in automatic departure.
  • When the Bot is near its Discord guild capacity, we may ask the original inviter to confirm continued activity by logging into ARK Status. If no notice can be delivered, no inactivity timer starts. If notice is delivered and the inviter does not log in within the stated response window, the Bot may leave that guild to make room for active communities.
  • We periodically verify authorisation against our managed server list. Guilds that are no longer approved, exceed allocation limits, or repeatedly trigger errors may be removed without notice.
  • When we leave a guild, we queue deletion of managed configuration (including server definitions and sticky-message metadata) via our administrative API. Residual diagnostic logs age out within 30 days.
  • You may request manual removal or data deletion at any time by emailing [email protected] or via the contact options on arkstatus.com.

6. Liability and Availability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, your statutory rights as a consumer, or any liability that cannot be excluded or limited under applicable law.

  • The Service depends on third-party game data, Discord, PayPal, Cloudflare, hosting providers, browser vendors, and other infrastructure we do not control. We are not responsible for failures, outages, rate limits, data errors, policy changes, or removals caused by those third parties.
  • Server status, rankings, history, alerts, bot messages, webhooks, API responses, calculators, and marketplace information are provided for convenience and may be delayed, incomplete, cached, inaccurate, or unavailable.
  • We do not guarantee that the Service, Premium benefits, Discord bot, APIs, notifications, or data collection will be uninterrupted, error-free, secure, or available at any particular time.
  • If you use the Service as a consumer, we are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but not for business losses or losses that were not foreseeable.
  • If you use the Service for business or commercial purposes, to the maximum extent permitted by law we exclude liability for loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, indirect loss, consequential loss, and decisions made using Service data.

7. Prohibited Uses

  • Commercial resale of our data
  • Automated scraping beyond 1 request per minute
  • Reverse engineering of API endpoints or internal tooling
  • Impersonation of official ARK Status services or staff

8. User Accounts and Discord Integration

We provide user account functionality via Discord Single Sign-On (SSO):

  • Account creation requires Discord authentication
  • We collect minimal profile information from Discord
  • You may save favourite servers and configure webhook notifications
  • We reserve the right to limit or revoke account features

Discord webhook usage is limited to reasonable usage patterns. Excessive notifications or abuse of any webhook or bot feature may result in service limitations.

9. Third-Party Content

Links to game servers or external sites are provided for convenience only, and do not constitute an endorsement. These third parties may have independent terms; we do not control their content.

10. Player Marketplace

ARK Status operates a player-to-player Marketplace where signed-in users can publish classified listings for in-game creatures and blueprints and arrange trades directly with each other. The Marketplace is a listings board only. ARK Status is not a party to, broker of, agent for, escrow for, or guarantor of any trade, and does not verify, endorse, or take responsibility for any seller, buyer, listing, price, item, or the legitimacy, ownership, or in-game delivery of anything listed.

  • All trades are arranged and completed in-game between players. Listings may only be priced in in-game items or currency.
  • Real-money trading is prohibited. You must not buy, sell, solicit, or arrange any listing for real-world money, cryptocurrency, gift cards, account credentials, or other off-game consideration. Real-money trading also breaches Studio Wildcard’s terms for ARK, and listings that attempt it may be blocked or removed and the account suspended.
  • Listings, sellers, buyers, items, and any linked Discord profile or server invite are provided “as-is” and without any warranty. ARK Status does not guarantee that an item exists, is legitimately obtained, will be delivered, or matches its description.
  • You use the Marketplace and contact other players at your own risk. Verify the other party through their linked Discord profile, complete the hand-off yourself in-game, never use a “middleman”, and report anything that looks like a scam. To the extent permitted by law, and subject to the Liability and Availability section above, ARK Status is not liable for any loss arising from a trade or attempted trade between users.
  • You are responsible for your listings and conduct, and you must not post content that is illegal, fraudulent, abusive, infringing, or otherwise in breach of these Terms. We may, at our discretion and without notice, refuse, edit, hide, or remove any listing, hold listings for moderator review, and limit or suspend Marketplace or selling access where an account breaches these Terms, abuses the Marketplace, or creates a fraud, security, or safety risk.

11. Governing Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction. If you are a consumer, you may also have mandatory rights and court protections in the country where you live.

12. Service Changes

We may change or discontinue the Service:

  • With 7 days’ notice via a website banner where feasible
  • Subject to the Liability and Availability section above, without liability for interruptions outside our reasonable control

Premium-specific changes are handled under the Premium Service section above. If the EU-UK data adequacy status changes, we may implement alternative transfer mechanisms or restrict EU data processing if needed.
